New requirements of Turkish legislation on short-term rentals

What are these innovations? On January 1, 2024, a decree regulating the conditions for short-term rental of real estate came into force. Let us consider in detail the new requirements of Turkish legislation on short-term rentals.
✅ To rent out an apartment for short-term rent, you will need to obtain a license from the Ministry of Culture and Tourism and hang a sign at the entrance to the building stating that housing is for rent here. The cost of licenses will be determined by the ministry.
✅ The consent of all apartment owners in the building is required to obtain a license for short-term rental. The license is obtained for the house as a whole, and not for an individual apartment. Obtaining the necessary licenses for the house will take approximately 3 months.
It is not yet clear how this requirement will be fulfilled, given the multinational composition and non-permanent residence of the majority of owners of houses and residential complexes in resort cities, but it is reported that management companies will be sent a sample of the necessary permission from the owners.
✅ If one owner has more than 5 units of real estate for rent in one building, then he needs to register rental activities as a legal entity.
✅ The responsibility to obtain permission lies with the landlord. Or the owner can contact a management company, which will formalize and track everything necessary for him.
✅ Subletting is prohibited. The tenant cannot rent out housing rented from the owner to third parties at his own expense and on his own behalf.
✅ It is still necessary to register all guests in the police system, providing detailed passport information of the tenants.
✅ In complexes with hotel infrastructure, where the complex management plan (yönetim planı - a set of rules in accordance with which accommodation in the house will take place) indicates short-term rental activities, there will be no need to obtain an additional license; these complexes will be suitable for short-term rentals.
✅ Publishing advertisements on the Internet from persons without licenses is prohibited.

Penalties for violating the rules for short-term rentals:
If the owner rents out an apartment without permission and if there is no sign on the house from the Ministry of Tourism, then the initial administrative fine will be 100,000 liras; If within 15 days the owner does not receive permission and continues to rent out housing illegally, the fine will be 500,000 lire.
If the tenant has taken an apartment from the owner for a long-term lease and in the meantime is engaged in renting out this housing for short periods, there is also a fine of 100,000 lire.
