Changes to the law on short-term rentals
In Turkey's legislative framework, changes were recently made to the law on short-term rentals (less than 100 days). The regulation on the regulation of rental houses for tourism purposes was published on May 30, 2024 in the Official Gazette of the Turkish Republic, No. 32561. This time the Ministry of Culture and Tourism of the country is meeting the owners halfway, simplifying the rules, and a number of changes in the law, which was tightened a year earlier, expands the possibilities for renting out housing in short term rental:
▪ Now the concept of “residence” includes complexes that have any two points of mandatory infrastructure. This means that the housing in them is suitable for tourist rental. Previously, the following services were required:
reception,
security and daily cleaning of premises,
medical services,
dry cleaning,
laundry,
transfer,
food services and shops,
Gym,
pool.
Now, at least two of the above points are sufficient on the site where the complex is located, in contrast to the previous condition of the availability of services in the complex itself. For example, most of the already built complexes do not have laundry facilities at their disposal, so innovations greatly simplify life for landlords from these residential complexes.
▪ One of the most important points is the agreement of all 100% of the owners that the apartments in the building will be rented out for short-term rent. Now the consent of the majority (4/5) of the owners is required. The decision on short-term rentals for tourism purposes must be included in the charter of the complex. 55 The deadline for fulfilling the requirements has been extended until December 31, 2024. But it is even more convenient that the Management Company can independently change the charter of the complex, specifying in it the possibility of tourist rental. In this case, the consent of all owners, holding a meeting, etc. will not be required.
▪ The terms for reviewing the issuance of licenses have also changed – from 30 to 60 days. If the test is not passed the first time, no fine will be imposed; the certificate holder is given another 15 days to correct the shortcomings. And if the deficiencies are not eliminated, then an administrative fine is imposed and another 15 days are given to correct them, otherwise the permit will be revoked.
Finally, all the bureaucratic obstacles regarding the issuance of documents have been resolved. Alanya has already begun issuing licenses for short-term rentals. Recently the first owners received their permits.
